Can You File an AI-Generated Logo with the INPI?
The question that worries entrepreneurs
You have just created your logo with BrandMotion Lab. It is perfect. You want to protect your brand by filing it with the INPI, France's industrial property office. But one question is holding you back: can an AI-generated logo be registered? Is it recognized as having protectable originality?
The short answer: yes, you can file an AI-generated logo with the INPI. Here is why, and how.
The current legal framework (France, 2025)
Under French intellectual property law, two notions apply to your logo:
- Copyright: it protects original works stemming from human creativity. A logo generated entirely by AI, without significant human input, may in theory not be protectable by copyright (the case law is still being built).
- The trademark (INPI): this is a separate right. It protects a sign (logo, name, slogan) as an identifier of a commercial activity. It does not require originality in the copyright sense — it requires distinctiveness.
Conclusion: even if copyright over your AI logo is uncertain, filing the trademark with the INPI remains perfectly valid.
The conditions for registering your AI logo as a trademark
1. Distinctiveness
Your logo must not be descriptive of your activity (a logo depicting a baguette for a bakery will be refused). It needs a personality of its own that allows your business to be distinguished from the competition.
2. Availability
Your logo must not resemble an earlier trademark in the same INPI class. Run a prior-rights search on INPI.fr before filing.
3. Lawfulness
Your logo must not contain anything contrary to public policy or infringing a third party's rights.
The filing process, step by step
- Prepare your logo file: SVG or EPS format in black and white (colors optional), transparent background, sufficient resolution
- Identify your Nice classes: choose the INPI classes matching your activity (e.g. class 35 for marketing services, class 43 for food service)
- Run a prior-rights search on base.marques.inpi.fr
- File online at depot.inpi.fr — cost: €190 for 1 class (+ €40 per additional class)
- Wait for publication: the INPI publishes your filing in the Bulletin Officiel de la Propriété Industrielle (BOPI). A 2-month opposition window opens.
- Final registration: absent any opposition, the trademark is registered for 10 years, renewable.
What BrandMotion Lab provides for your filing
BrandMotion Lab delivers with every logo: the SVG file (a format accepted by the INPI), the EPS file (as an alternative), and the black & white monochrome version. You have everything you need for your filing as soon as your pack is delivered.
Practical advice
For a strategic filing (international trademark, competitive sector), work with an intellectual property attorney (conseil en propriété intellectuelle, CPI) or a specialist lawyer. The cost of that support (€400-800) can save you a costly trademark cancellation later on.
